What Is An RTO?

Failure to comply with the standards set by ASQA would result in plenty of repercussions. A history of non-compliance would have to face:

1.   Cancellation or suspension of registration:

An RTO facing non-compliance would have to deal with removal of their licence. ASQA would ensure that their registration as an RTO would be cancelled or suspended depending on the severity of their non-compliance. The RTO would no longer be allowed to provide services of the VET sector they used to offer.

2.   Directing compliance:

This can be done by issuing warning letters, interviews, written agreements and certain conditions placed on the RTO. ASQA makes sure to respond accordingly based on the risk they oversee with the RTO. These are simply a way for the RTO to understand that they are being watched on the motive of non-compliance. To ensure that the message has been conveyed successfully, ASQA mandates that RTOs send written agreements and reports to confirm.

3.   Injunctions or court actions:

In the case of finding an RTO that does not comply with their rules and have broken the regulations severely, they can be held up in court or injunctions for their actions. This is to ensure that all RTOs stay in accordance with ASQA guidelines and approvals. RTOs must approve their VET sectors and services beforehand. If an RTO is found to offer unapproved VET services, they can be taken to court.
